  • conversion of foreign currency mortgages into rubles at a fixed preferential rate.

Another economic crisis prompted the state to support mortgage borrowers who find themselves in a difficult financial situation.

An effective measure is the publication on April 20, 2015 of the Decree number 373, the author of which is the Government of the Russian Federation.

The implementation of the program to support mortgage holders, provided for by this regulatory act, is carried out by the AHML structure, that is, the Agency authorized to deal with issues of stimulating mortgage lending. Initially, this document regulated that the aforementioned financial assistance program would be valid until the end of 2016. However, this resolution was later repeatedly supplemented with new norms and changed.

After a break, state support for mortgage loan recipients is being resumed. In July 2017, an additional 2 (two) billion rubles are allocated for the implementation of the assistance program. The source of these funds is a special government fund. New conditions and requirements, according to which mortgage borrowers can fully participate in the state assistance program, are established by the next government decree. The number of the normative act is 961. The beginning of this document is dated August 11, 2017.

The terms of participation

Currently, mortgage borrowers who intend to become full participants in the government's preferential financial assistance program are subject to the following conditions:

  • The borrower's obligations to the creditor bank on the target housing loan are reduced in the amount of 20-30% of the remaining (outstanding) loan amount. The financial institution independently determines the amount of such a reduction, the maximum amount of which may be 1.5 (one and a half) million rubles.
  • The creditor bank and the citizen-borrower have the right to independently agree on the format of the assistance provided. The first option - the entire amount of such support is fully directed to the closing of the principal debt on the mortgage, which allows the borrower to reduce the amount of the monthly payment. The second option - the amount of assistance provided is used to reduce the monthly payment by at least 50% for a period not exceeding 18 (eighteen) months.
  • A mortgage loan issued earlier in a foreign currency is subject to replacement with an ordinary ruble mortgage. The annual interest rate on a mortgage loan does not exceed 11.50%. The annual interest rate for mortgages in domestic currency does not exceed the interest rate set by a specific bank institution, except in cases of violation of the basic insurance rules provided for by the mortgage agreement.
  • A special interdepartmental commission is being created, authorized to increase by 100% the size of the maximum payments provided for by the program, and to issue an approving verdict on applications of applicants for participation when there are deviations from the basic requirements for a maximum of two points.

Commercial banks often refuse to restructure mortgage loans, some borrowers say. However, this measure is beneficial to financial institutions. After all, the state reimburses banks for interest income lost due to early closure of mortgages.

Changes made on February 10, 2017 to the terms of the financial assistance program for mortgage borrowers provide that compensation of a maximum of 30% of the remaining loan amount, not exceeding 1.5 (one and a half) million rubles, is provided to the applicant in the following cases:

  1. The applicant's family has two children.
  2. The borrower is disabled.
  3. The borrower has a child with a disability.
  4. The applicant is a combat (military) veteran.

If the recipient of a mortgage loan has one child, he is entitled to claim only 20% of the balance of this loan. The changes made in the conditions of the program on August 10, 2017 make it possible to increase the maximum amount of this payment by 100% if a special interdepartmental commission approves such an increase.

It should be noted that there are also negative opinions about the state assistance program for mortgage borrowers. As their detailed analysis shows, the main reasons for the rejection of applications are often associated with the provision of false information by citizens and insufficient knowledge of the basic requirements of this program. For example, not all applicants for participation in the program take into account the fact that the borrower has the right to apply for restructuring no earlier than 12 (twelve) months from the date of the mortgage loan.

Who is eligible to participate in the support program: list of applicants

The list of categories of entities entitled to count on state assistance in the payment of a mortgage loan is provided for by government decree number 373. The corresponding changes were made to this normative act on November 24, 2016.

Thus, the following types of borrowers are eligible to apply for financial assistance:

  • Russian citizens with at least 1 (one) child (minor).
  • Guardians or, alternatively, guardians who have at least one (1) child (minor) as a ward.
  • Participants in military (combat) operations.
  • Disabled (official status).
  • Borrowers who have children with disabilities.
  • Russian citizens who actually have children under the age of twenty-four who are educated in an educational institution (full-time education).

What are the requirements put forward by the program for mortgage housing

The State Assistance Program for Mortgage Borrowers also provides for certain requirements for a mortgaged apartment:

  1. The total area of ​​the loaned housing in an apartment building must be a maximum of 45 square meters - for a one-room apartment, a maximum of 65 square meters - for a two-room apartment, a maximum of 85 square meters - for an apartment with at least three living rooms.
  2. The price per square meter of the total area of ​​the loaned housing may exceed the average cost per square meter of a typical apartment located in the region of the borrower (applicant) by a maximum of 60% (as of the date of execution of the mortgage agreement). Official statistics are taken into account.
  3. The credited apartment is the only living space of the mortgage borrower. The total share (part) of the property attributable to the borrower in other housing does not exceed 50%. Accounting for the presence of such property is carried out from 04/30/2015. In other words, a mortgage borrower applying for participation will not be able to quickly re-register his, relatively speaking, excess real estate to someone else.

Essential nuance– The above restrictions on the total area of ​​housing to be financed and the price per square meter do not apply to families with at least three minor children.

If the share (part) of the borrower's property in another housing area exceeds 50%, his application will be rejected, but, as an option, the applicant can simply re-register this property to one of his relatives. In addition, you should know that from August 11, 2017, all disputes related to the areas of apartments and deviations from the parameters of the program are resolved by a special interdepartmental commission.

What conditions must an applicant meet?

The requirements for the financial assistance program for a mortgage borrower are as follows:

  • An applicant for state assistance in repaying a mortgage must be a citizen of the Russian Federation.
  • The applicant's earnings, minus the monthly mortgage payment, must not exceed twice the subsistence level adopted for the locality in which the mortgage borrower lives, for each family member. In connection with the crisis, many borrowers have lost their ability to pay before the bank. In the spring of 2015, a meeting of the Government was held, where the question was decided - what measures the state would take in the current situation. As a result, Decree No. 373 of April 24, 2005 was issued. and the Home Mortgage Insurance Agency established.

AHML is a federal agency in the form of an open joint stock company with 100% state capital. The Agency received 4.5 billion rubles from the state to assist borrowers, and subsequently (11/24/2016) additional changes were made to the program.

Acceptance of applications from those wishing to take part in the program was completed on March 7, 2017. This is due to the fact that the funds allocated for assistance were used up.

By Government Decree No. 961 of August 11, 2017, assistance for those borrowers who, due to circumstances, found themselves in a difficult situation with a mortgage, was extended.

This is primarily due to the fact that most of the clients who used a home loan were left in a difficult situation and could not cope with payments without the help of the state.

In accordance with the new program, borrowers are entitled to write off 30% of the remaining debt, but in an amount not exceeding 1,500,000 rubles.

Citizens who have taken a mortgage loan can expect:

The new program: its essence and goals

In the new program to support borrowers, priority is given to special conditions for a loan taken in foreign currency.

According to Government Decree No. 961 dated August 11, 2017, the following categories of borrowers can receive special conditions:

  • Disabled or having disabled children;
  • If there is one or more children under 18 in the family;
  • Citizens in whose care there are persons under 24 years of age;

  • Veterans who participated in the fighting.

According to the assistance program, two more conditions must be met:

  1. First, the amount of the monthly payment on the mortgage loan has increased by at least 30 percent compared to the amount of the planned monthly payment calculated as of the date of conclusion of the loan agreement.
  2. The second condition is as follows: three months before the proposed restructuring, the income for each family member must be less than two living wages.

The Government explains the decision to help borrowers who have taken out mortgages in foreign currency by the fact that the first wave was aimed at ruble mortgages, and the 2017 program was aimed at foreign currency housing loans.

Requirements for the borrower

Borrowers must meet the following requirements:

  1. Citizenship of the Russian Federation;

Conditions for real estate

An apartment issued on a mortgage loan must meet certain requirements. If at least one of them is not observed on the appeal, a refusal will be received.

The requirements are the following:

  • Housing must be unique;
  • The mortgage agreement must be signed at least 12 months before applying for debt restructuring;
  • The cost of one square meter should not exceed 60% of the average cost in the region of residence.

There are also restrictions on the size of the apartment.

For a one-room dwelling, the limit is set to 45 square meters, a two-room dwelling cannot exceed 65 square meters, and a three-room dwelling cannot exceed 85 square meters.

If he takes part in mortgage lending, then he is obliged to provide all the documentation about himself and his family members.

List of documents for participation

If the borrower decides to seek help from AHML and revise the debt, he needs to come to the bank branch and tell about his intention.

The specialist will direct the client to the branch where they deal with overdue debts, where the borrower will be told what documents must be provided to participate in the program.

  1. A statement where the borrower indicates the reason for non-payment. This may be the loss of a job or a decrease in family income;
  2. Questionnaire for loan restructuring;
  3. Passports and birth certificates of all family members;
  4. Marriage document;
  5. Certificate if the marriage is dissolved. When changing the surname, an appropriate document is also required;
  6. Certificate of a veteran of military operations, if a citizen belongs to this category;
  7. Documents confirming the status of a disabled person (if any);
  8. The dependent presents a birth certificate;
  9. Dependents bring a certificate from the university confirming the completion of training;
  10. Information about the composition of the family;
  11. Notice from the pension fund that there is no independent income;
  12. A copy of the work book (must be certified);

  15. A document confirming registration with the employment center and a work book, this applies to unemployed persons;
  16. Certificate in the form 2-NDFL from the borrower, as well as members of his family;
  17. Certificate from the FSS of the Russian Federation on the assigned benefits and other payments;
  18. A document issued by a pension fund on the status of a personal account. This is a mandatory document for all;
  19. Certificate of joint family income in the form of a bank;
  20. Pensioners provide a certificate of the amount of the pension;
  21. Validation of patents and tax returns;

  24. Collateral valuation agreement;

Terms and maximum amount of support

Decree No. 961 does not specify the period for the implementation of the program; it will end when the funds allocated to help borrowers run out completely.

To prevent such a situation, in 2015, a state program was developed to support mortgage borrowers.

Legislative framework

This system began operating in 2016. Its foundations are set out in Decree of the Government of the Russian Federation No. 373 “On the main conditions for the implementation of the assistance program ...” dated April 20, 2015. For less than two years, it was suspended, but then resumed again. In August 2017, the Government of the Russian Federation decided to resume the program that had been stopped by that time, which was enshrined in Decree No. 961 of August 11, 2017. The deadline for the state support was not specified, and in 2018 it is valid in the prescribed amount. To date, state support has been provided to almost 19,000 families who find themselves in a difficult financial situation.

Since its first adoption, Decree No. 373 has been constantly refined and improved, new significant points were introduced into it, which improved the interaction procedure and took into account the interests, primarily of borrowers. The document prescribes the main conditions for participation in the program and the amount of funds allocated from a special government fund. In 2017, two billion rubles were allocated for the implementation of the program.

Supporting body

The program of state support for mortgage borrowers is carried out through the Ministry of Construction of the Russian Federation, and is directly implemented by the Joint Stock Company Agency for Housing Mortgage Lending (AHML). This structure is authorized to consider candidates applying for state financial support and stimulate housing lending.

AHML is a state organization and its budget is 100% made up of state capital money. This structure has a clear purpose - to support banks that are engaged in long-term mortgage lending.

Cooperation between banks and AHML proceeds according to the following scheme:

  1. A citizen applies to a credit institution and receives a loan from it for the purchase of housing.
  2. Under certain conditions, the borrower applies to AHML for state support. The allocated money is not given in cash to the hands of the needy, but is transferred directly to the creditor for partial repayment of the debt.
  3. The bank restores its financial reserves at the expense of the issued funds, and the transferred amount is debited from the payer's debt.

The bank in such operations respects its interests, and the borrower receives financial support from the state and extends the possibility of repaying the debt.

Categories of borrowers

Government Decree No. 373 provides a complete list of citizens who have the right to count on participation in the developed program. The list was approved in 2015 and slightly adjusted in November 2016. It includes:

  1. Parents who have one or more minor children.
  2. Guardians or trustees raising one minor child or more children under the age of 18.
  3. Citizens who took part in hostilities.
  4. People with any degree of disability, if there is official confirmation of this fact.
  5. Parents raising a child with a disability.
  6. Parents who support children over 18 years old, but under 24 years old, provided that they study full-time in educational institutions.

The conditions apply only to people who have Russian citizenship, a Russian passport and permanent registration in Russia.

Requirements for borrowers

Repayment of the mortgage at the expense of the state is possible, but it is necessary to comply with the established requirements. The borrower must fall under one of the listed categories and be a citizen of the Russian Federation, but this does not guarantee him that assistance will be provided.

One of the most important indicators is the level of wages at the moment and the ratio of the amount of payment on the loan on the day of registration and on the day of applying to AHML. The applicant must have a low monthly income. The salary limit is calculated as follows:

  1. The amount of the mortgage loan payment is deducted from the monthly income.
  2. The remaining amount should not exceed the subsistence minimum in double size. The PM of a particular region is taken as a basis. The amount of income is divided among all family members.

Data for the last three months are taken into account. AHML specialists proceed from the fact that the previously established loan payment should increase by at least 30%. This situation often develops among those citizens who have issued a foreign currency mortgage or taken a loan at a floating interest rate.

Loan Requirements

In order to receive financial assistance, it is essential that the loan itself meets the established requirements. They apply mainly to the amount of the mortgage loan. It is extremely unreasonable to set any restrictions in monetary terms, because the cost of residential properties varies depending on the region and locality, so the requirements are put forward directly to real estate taken on a mortgage. The mortgaged property must meet the following criteria:

  1. The area of ​​the property must not exceed 45 m2 for a 1-room apartment, 65 m2 for a 2-room apartment and 85 m2 for a 3-room apartment.
  2. The cost of one square meter is calculated at the average price in a given locality. Exceeding the average is allowed no more than 60%.

Please note that all of these restrictions on credit and housing size do not affect families with three or more minor children.

Terms of participation in the program

You can apply for state support only if one of the main conditions is met, which is often not taken into account by debtors - a mortgage loan must be issued at least a year ago. If the loan was taken just a few months ago, you should not count on debt restructuring. All efforts of the state are not aimed at releasing the borrower from credit obligations. Support only reduces payments to an acceptable level, leaving the citizen with an amount that he can repay on his own.

You can count on financial assistance only once. Moreover, if the application is rejected due to insufficient grounds, then the citizen can apply to a special interdepartmental commission. It was approved in 2017 and allows a more individual approach to the consideration of situations. The Commission can not only decide on the need for assistance on a previously rejected application, but also increase the amount of compensation by any number of units, up to 100%.

Help Format

The end result of state aid is expressed in terms of money, but what format will be chosen in each case depends on many circumstances. There are two main ways to reduce monthly payments:

  1. Reducing the debt obligations of the borrower.
  2. Transfer of a foreign currency loan into a ruble equivalent.

The choice of option depends, first of all, on the initial data of the loan taken.

The state support program was developed after the economic crisis significantly weakened the financial capabilities of payers. A few years ago, mortgages were issued at floating rates, since this aspect was not regulated by the state. Such an order well protects the credit organization itself from loss of profit, but for the borrower it can become a debt trap, which actually happened to many payers.

Difficult circumstances and the fact that the income level of a large number of citizens has seriously fallen, negatively affected, first of all, their ability to pay.

Reducing the borrower's obligations

The borrower's obligations are reduced according to a certain scheme. The first thing that the financial institution decides is how much to compensate the applicant. There is no set minimum size in this case, but there is a maximum. Often, 20-30% of the total outstanding mortgage debt is reimbursed. It is envisaged that the amount of state support should not exceed one and a half million rubles.

The following categories of citizens will be able to repay 30% of the debt:

  1. The family has two minor children.
  2. Established disability.
  3. Parents are raising a child with a disability.
  4. The applicant is a combat veteran.

Families with one child can only receive 20% of the remaining mortgage debt. Please note that an exception to this rule may be made if the interdepartmental commission decides that a large amount of the debt is due.

It is important to determine not only how much money will be compensated from the budget, but also how it is provided. There are two support options:

  1. The entire agreed amount is deducted from the balance of the debt, after which the amount of monthly payments is recalculated.
  2. The provided amount of money is divided into parts, each of which will be used to compensate for the monthly payment. In this case, there are two significant limitations. First, you can compensate no more than 50% of the monthly installment. And secondly, the duration of such payment should not exceed 18 months.

Which option to choose is decided between the borrower and the lender, but the prerogative is given to the citizen, because the financial institution does not lose anything in either case.

Replacing a foreign currency mortgage with a ruble one

Many mortgage borrowers found themselves in an unpleasant situation of financial collapse precisely because they once issued a loan in foreign currency. Long-term stability in the foreign exchange market weakened the vigilance of citizens, and it began to seem that nothing would shake the current situation. The amount of mortgage loans taken due to the jump in the exchange rate increased several times. And given the interest rate applied to them, the repayment of contributions has become simply unrealistic.

The state support program allows citizens who have issued a mortgage in foreign currency to convert a loan into a ruble equivalent.

The restructuring of such loans is carried out not at the established rate, but according to the laws adopted today. The interest rate applied to the ruble equivalent should not exceed that provided by the bank today for registration of mortgage programs. The rate can be increased only in one case, if the borrower has violated the established insurance rules stipulated by the loan agreement.

Documents for restructuring

Financial institutions consider an application for debt restructuring with the help of state support only if the borrower provides a mandatory package of documents for consideration of his candidacy. Data on his financial and marital status must be confirmed and fit the conditions of the program.

The list of documents consists of the following forms:

  1. Passport.
  2. Valid loan agreement.
  3. Documents for minor children - birth certificates.
  4. Certificate of disability or participation in hostilities and obtaining veteran status.
  5. A certificate from a medical institution if the minor child has a disability.
  6. Income statement for the last three months.
  7. A copy of the work book from the employer or its original if the person is not working at the moment.
  8. A certificate from an educational institution stating that an adult child is a full-time student.
  9. Guardians and adoptive parents must provide a decision of the guardianship authorities and a court order.
  10. Extract from the EGRP.
  11. Insurance policy.

Procedure

In order to receive state financial support to repay part of the remaining mortgage loan, the borrower will need to go through a phased procedure. It consists of the following steps:

  1. A package of documents is submitted to the credit institution that issued the mortgage loan.
  2. The bank considers the submitted application and issues its verdict.
  3. If the decision is positive, the applicant proceeds to the next step, and if the decision is negative, he can apply to the interdepartmental commission for a more detailed consideration of the circumstances and a more individual response.
  4. A new loan agreement is concluded or an additional agreement is being prepared for an existing form.

Contacting the bank

Many borrowers complain that the bank refuses to restructure their mortgage loan, not wanting to consider documents for state support. It should be borne in mind that not all credit institutions are included in the AHML list, which makes it difficult to cooperate. If the refusal is the initiative of the bank, then you can safely apply to the interdepartmental commission, since such actions are considered illegal.

The borrower, who, at his own discretion, fits the established requirements and conditions of state support, is required to fill out an application form. This form is confirmed by the collected documents and submitted to the creditor for examination and final verdict.

A positive decision results in a revision of the previously established amounts of payments. Before signing new agreements with the bank, you should decide on the method of compensation - one-time or in parts to pay off monthly payments.

Contacting AHML

The entire registration procedure is carried out in close cooperation between the bank and AHML. If the process goes in the standard way, then the citizen will not have to apply to AHML on his own, this is done by the lender. The bank submits the already considered documents to the agency, which, on their basis, transfers the agreed amount of compensation to the financial institution.

If the creditor rejected the application for debt restructuring or decided to compensate only a small part of it, which, in the opinion of the property owner himself, is unjustified, a commission consideration of the situation can be initiated. In some cases, the commission may decide to pay 100% of the debt, but for this the grounds must be very good.

New rules for the state program to help mortgage borrowers in difficult financial situations came into force in Russia on August 22. At the end of July, Russian Prime Minister Dmitry Medvedev signed a decree on the allocation of another 2 billion rubles from the government's reserve fund to the program as a contribution to the authorized capital of the Agency for Housing Mortgage Lending (AHML), and on August 11, a decree specifying the conditions for implementing the program.

The program itself went into effect seven days after the publication of the official legal information on the website, explained Alexei Nidens, managing director of the Agency for Housing Mortgage Lending (AHML, operator of the program).

“But borrowers can seek advice and apply to banks for participation in the program now - the procedure for working under the program is already well known to most credit institutions,” Niedens says.

According to AHML, the program involves 97 banks that cooperated with AHML earlier under the previous version of the program.

Borrowers who have passed at least 12 months from the date of obtaining a mortgage loan to the date of filing an application for restructuring, and whose monthly loan payment has increased by at least 30%, will be able to take part in the program. The mortgaged housing must be the only housing of the mortgagor's family. At the same time, the total share of his family members in the ownership of no more than one other residential premises is allowed in the amount of no more than 50% from April 30, 2015.

The new phase of the program to support mortgage borrowers provides for more flexible criteria for providing assistance than it was in the old program, said Deputy Finance Minister Alexei Moiseev.

This will be facilitated by a special interdepartmental commission, which should be created before September 1, 2017. The composition of the commission and the procedure for its work will be determined by the Ministry of Construction of Russia. The Commission will have the right to make decisions on providing support to citizens who formally do not meet the individual conditions of the program, but are in dire need of it.

So, for example, by decision of the interdepartmental commission, in exceptional cases, the basic amount of assistance from the state can be increased from 1.5 million rubles, but no more than twice.

"Mortgage borrowers who have taken a loan both in rubles and in foreign currency will be able to apply for participation in the program. The amount of the monthly payment on a foreign currency loan may increase due to changes in the exchange rate, and on a loan initially in rubles - for example, due to an increase in the interest rate, if it was not initially fixed for the entire loan term," AHML explained to TASS.

The basic amount of assistance from the state will be 30% of the balance of the loan amount, but not more than 1.5 million rubles, in special cases - up to 3 million rubles.

The restructuring of the ruble mortgage will be carried out at a rate not higher than that in force on the date of conclusion of the restructuring agreement.

Also, borrowers are exempted from paying a penalty under the terms of the loan, however, payments already made on the penalty are not refundable. They are also prohibited from taking commissions for restructuring loans.

If the loan was issued in a foreign currency, it must be changed into rubles at an exchange rate not higher than that set by the Bank of Russia at the time of the loan restructuring.

At the same time, the rate on a restructured foreign currency mortgage should not exceed 11.5%.

To reduce loan obligations, the borrower may be offered one of the types of restructuring: for loans previously issued in foreign currency, the currency is changed to rubles at a rate lower than that established by the Bank of Russia at the time of the conclusion of the restructuring agreement; one-time forgiveness of part of the loan amount.

When concluding a restructuring agreement, the lender is not entitled to charge the borrower fees for actions related to restructuring, as well as reduce the loan term.
